# Arrest Procedure

**ON-SCENE OBLIGATIONS** The following should take place on the scene where the initial arrest takes place.

* The suspect(s) should be advised that they are in-fact under arrest.
* The suspect(s) should be advised of what charge(s) they are facing.
* The suspect(s) should be searched. This includes their person, and any property or mobile conveyance within arm's reach while the crime(s) were being committed. Searches should not violate any limitations set forth by the Fourth Amendment of the United States Constitution.
* If any suspect(s) require medical aid, make sure they receive that aid as soon as is it is safe to do so. Preservation of life is always top priority.

Once all of these things have occurred, transport the suspect(s) to the nearest safe Ranger or Marshal station. **PROCESSING** This includes what should take place upon arrival at the station.

* Suspect(s) should immediately be escorted inside and locked in a cell, no exceptions.
* Ensure that suspect(s) receive any basic provisions they need for survival including food, water, and medical care.
* Run names of anyone in custody through the MDT. Make sure that all suspect(s) have a citizen file with an accurate mugshot. If these do not exist, make one.
* Suspect(s) should be advised of their charges once again, and given a chance to enter either a Guilty or Not Guilty plea. Every arrestee MUST be given a chance to enter their plea, no exceptions.

**SUSPECT PLEA PROCESS** If a suspect enters a Guilty plea, reference the Sweetwater County Penal Codes document and issue necessary fines based on what that document outlines for the charge(s) at hand. It is recommended to go ahead and figure out what their prison sentence will be as well while you have the document open. Once you have communicated to the suspect what fines they will be expected to pay and the amount of prison time they will be expected to serve, immediately begin the transport process to the Sisika Ferryman and complete the transfer process to Sisika Penitentiary. If a suspect enters a Not Guilty Plea, the following will need to take place.

* Suspect(s) must post 50% collateral of the total monetary value of all offenses charged before they can be released. To find this amount, reference the Sweetwater County Penal Codes document, add the fines for all charges, and divide that number by 2.
* Use good officer discretion to facilitate the process of the suspect(s) withdrawing or retrieving funds.
* The attached Bail Terms & Conditions should be read to them in full, and the suspect(s) must verbally acknowledge that they understand the conditions of their bail. The document has specific provisions in place if someone is charged with a 100 series offense. If someone is facing one of those charges, read those specific conditions to them. If not, that specific portion can be left out.
* They can be released once all of these procedures have been satisfied.

**POST ARREST**

* If a Not Guilty plea is entered, notify your agency head immediately either by post or newspaper.
* Ensure that evidence is placed in the correct location.
* Complete and submit your written report within 24 hours of the arrest. It is not recommended that you complete your report while someone is in custody. Write it after they're gone.
